\"CDC_CouncilChamber\"On Monday 5th December Cherwell D.C. Excecutive have to decide whether or not to recommend that the full council adopt the Bloxham Neighbourhood Plan at their subsequent Dec 19th Meeting.
\nAssuming the recommendation is accepted at each of these two meetings the Neighbourhood Plan should become\u00a0 part of local planning law by early in 2017.<\/p>\n

The more detailed notes to the executive\u00a0 state\u00a0 ” Where a referendum poll results in more than half of those eligible to vote voting in favour of the Neighbourhood Plan, the local planning authority must \u2018make\u2019 the Plan as part of the statutory development plan. There are no alternative options available unless the making of the plan would breach, or would otherwise be incompatible with, any EU obligation or any of the Convention rights (within the meaning of the Human Rights Act 1998).<\/p>\n

Based upon our reading of the planning rules<\/a> the Cherwell interpretation above is not strictly correct.\u00a0 The\u00a0 Planning Practice Guidance <\/a>states , ” If the majority of those who vote in a referendum are in favour of the draft neighbourhood plan or Order then the neighbourhood plan or Order must be made (brought into legal force) by the local planning authority within 8 weeks<\/a> of the referendum.<\/span>”
\nI.e. The plan must be adopted if\u00a0 half of those voting – not half of those eligible to vote – vote in favour.
\nBloxham Residents voted\u00a0 97% in favour on a 33% turnout. This is a very high “yes” response and a fairly typical turnout for a Neighbourhood Plan referendum. (Some have had to be\u00a0 implemented on an 11% turnout!)<\/span>
\n<\/em><\/span><\/p>\n

The recommendations in the CDC Executive Agenda<\/a> itself\u00a0 do seem to be correct and are set out below.<\/p>\n

\n

‘Making’ (Adoption) of the Bloxham Neighbourhood Plan (6.35pm)<\/strong><\/p>\n

Report of Head of Strategic Planning and the Economy.\u00a0 The\u00a0 Purpose of report is to propose the Executive recommends the \u2018making\u2019 (adoption) of the Bloxham Neighbourhood Plan at the meeting of the Full Council on 19 December 2016.<\/p>\n

Recommendations <\/strong><\/p>\n

The meeting is recommended:<\/p>\n

      \n
        \n
      1. \u00a0To note the referendum result of the 3 November 2016 where 97% of those who voted were in favour of the Bloxham Neighbourhood Plan which is above the required 50%.<\/li>\n
      2. To recommend to Council to resolve that Cherwell District Council as the local planning authority \u2018make\u2019 the Bloxham Neighbourhood Plan so that it is part of the statutory development plan for the District.<\/li>\n
      3. To recommend to Council to approve the issuing and publication of a decision statement stating that Cherwell District Council has resolved to make the Bloxham Neighbourhood Plan.<\/li>\n
      4. To recommend to Council to delegate to the Head of Strategic Planning and the Economy the correction of any spelling, grammatical or typographical errors, and the undertaking of any minor presentational improvements, prior to the Plan being adopted and published by Council.<\/li>\n<\/ol>\n<\/ol>\n<\/ol>\n
