On Monday 5th December Cherwell D.C. Excecutive have to decide whether or not to recommend that the full council adopt the Bloxham Neighbourhood Plan at their subsequent Dec 19th Meeting.
Assuming the recommendation is accepted at each of these two meetings the Neighbourhood Plan should become  part of local planning law by early in 2017.

The more detailed notes to the executive  state  ” Where a referendum poll results in more than half of those eligible to vote voting in favour of the Neighbourhood Plan, the local planning authority must ‘make’ the Plan as part of the statutory development plan. There are no alternative options available unless the making of the plan would breach, or would otherwise be incompatible with, any EU obligation or any of the Convention rights (within the meaning of the Human Rights Act 1998).

Based upon our reading of the planning rules the Cherwell interpretation above is not strictly correct.  The  Planning Practice Guidance states , ” If the majority of those who vote in a referendum are in favour of the draft neighbourhood plan or Order then the neighbourhood plan or Order must be made (brought into legal force) by the local planning authority within 8 weeks of the referendum.”
I.e. The plan must be adopted if  half of those voting – not half of those eligible to vote – vote in favour.
Bloxham Residents voted  97% in favour on a 33% turnout. This is a very high “yes” response and a fairly typical turnout for a Neighbourhood Plan referendum. (Some have had to be  implemented on an 11% turnout!)

The recommendations in the CDC Executive Agenda itself  do seem to be correct and are set out below.
